Child welfare court is called civil court. But many parents are treated like criminal defendants without criminal charges, without presumption of innocence, without proof beyond reasonable doubt, without the right to remain silent, without Miranda warnings, without a jury trial. They are investigated without warrants, questioned without lawyers, judged on hearsay evidence, ordered into services without convictions, supervised without charges, and separated from children without jury verdicts. There may be no criminal complaint, no indictment, no jury, no conviction, and no proof beyond reasonable doubt. Still, the consequences can be loss of custody, supervised visitation only, foster placement, court-ordered guardianship, adoption by strangers, and termination of parental rights. The civil label does not erase the constitutional injury. This book begins from one controlling principle: your rights don't disappear because the government calls it "civil." Your children don't become government property because an investigator filed a report. You have rights. This book teaches you how to enforce them.
